Article 1. Who I am

Article 2. Applicability

These terms apply to every offer, every order and every agreement you enter into with me via vechtstreekwijnen.nl. By placing an order, you agree to these terms and to my privacy policy.

Article 3. Account

To place an order, I may ask you for details such as your email address, billing and delivery address and payment details. These details must be correct and up to date. You are responsible for the security of your account details and for everything that happens with your account. Your account is personal and may not be transferred or resold.

Article 4. Offer and formation of the agreement

I do my best to display products accurately and truthfully. Colours and labels on your screen may differ slightly from the actual product, depending on your display, among other things. A vintage may also change if the vintage on offer is no longer in stock.

An order is an offer to purchase. The agreement is only formed once you receive an order confirmation from me by email. I reserve the right to refuse or cancel an order, for example in the event of an error in price or stock. In that case, I will inform you as soon as possible.

Products and prices may change at any time. No rights can be derived from obvious mistakes or typing errors in price or product information.

Article 5. Age limit and Dutch Licensing and Catering Act

I only sell alcoholic beverages to persons aged 18 or older.

Since 1 July 2021, stricter rules apply to the distance selling of alcohol. Both the person placing the order and the recipient of the parcel must be 18 or older. The delivery service checks this on delivery and may ask for identification. If in doubt, the parcel will not be handed over.

You are responsible for making sure the recipient can show identification and is 18 or older, also when you send an order to someone else as a gift. If a parcel is not delivered for this reason and is returned, the costs of the return and of shipping it again are at your expense.

Article 6. Delivery

I deliver to the address you provided with your order. I aim to ship within 1 to 3 working days. If delivery is delayed, I will let you know.

As soon as I hand the products over to the carrier, the risk of loss or damage passes to you. Delivery times are an estimate and not a firm guarantee. I am not liable for delays caused by the carrier or other circumstances beyond my control.

Article 7. Right of withdrawal and returns

For the right of withdrawal, registering a return and the conditions that apply, please refer to my return policy on the website. That policy forms part of these terms and conditions.

In short: you have a 14-day cooling-off period after receiving your order. Opened bottles of wine and damaged packaging are excluded from the right of withdrawal.

Article 8. Prices and payment

All prices include VAT and exclude shipping costs, unless stated otherwise. From €100, you pay no shipping costs for delivery within the Netherlands.

You pay using one of the payment methods offered in my webshop. Your details, such as payment details, must be correct and you are responsible for their accuracy. If payment is not received, I may terminate the agreement.

Article 9. Intellectual property

Everything you see on my website, such as texts, photos, the logo and the design, is owned by me or by the parties whose material I am permitted to use, and is protected by copyright and trademark law. You may only use this material for personal, non-commercial purposes. Without my written permission, you may not copy, distribute or reuse anything from my website.

The Shopify name and logo are the property of Shopify.

Article 10. Relationship with Shopify

My webshop runs on Shopify, which enables me to provide these services to you. All sales and purchases you make in my webshop are concluded directly with me. Shopify is not responsible for any aspect of a sale between you and me, including any injury, damage or loss resulting from purchased products. Shopify and its affiliates are hereby expressly released from all claims, damages and liabilities arising from or related to your purchases and transactions with me.

Article 11. Privacy

I only use your personal data to process your order and in accordance with applicable privacy legislation. Because my webshop runs on Shopify, Shopify also processes personal data in order to provide the webshop technically. You can read more about this in my privacy statement and in Shopify's privacy policy.

Article 12. Prohibited use

You may only use my website for lawful purposes. You may not use the website in a way that causes harm to me, to Shopify or to other users, or use viruses, automated tools, bots or AI agents to collect or copy data from the website, or to bypass security measures.

Article 13. Liability

The information on my website is intended as general information. I do my best to keep it accurate and up to date, but cannot guarantee it is entirely correct.

I am not liable for indirect damage, consequential damage, loss of profit or similar damage arising from the use of my website or the purchase of my products, except in the case of intent or gross negligence on my part. In the event of force majeure, I may suspend or terminate the agreement.

Article 14. Complaints and disputes

Do you have a complaint? Please let me know first at info@vechtstreekwijnen.nl. I will respond to your complaint in substance within 14 days.

If we cannot resolve it together, as an EU consumer you can also submit a complaint through the European Commission's ODR platform: http://ec.europa.eu/odr

All agreements between you and me are governed by Dutch law. We prefer to resolve any dispute through mutual consultation. If that is not possible, I will submit it to the competent court in Utrecht.

Article 15. Changes to these terms

I may change these terms at any time. The most recent version is always available on my website. I will let you know about important changes. If you continue to use the website after a change has been published, you thereby agree to the new terms.
